Ellumo Terms of Use

1. About these terms
These terms are an agreement between you and {{LEGAL_NAME}}, {{ADDRESS}}, {{COUNTRY}} ("we", "us") for the use of the Ellumo app and the Ellumo Cloud service. By using Ellumo you accept them. How we handle data is described in the Privacy Policy (https://ellumo.app/privacy). The terms of the App Store or Google Play also apply to your download and purchases.
2. What Ellumo does
Ellumo records audio on your device, turns it into a transcript, and uses AI to write summaries and answer your questions about your recordings. You choose how the AI part works:
- Own keys (free): transcription runs on your device or through an AI provider you connect with your own API key; summaries and answers come from that provider.
- Ellumo Cloud (paid, with a free trial): we run transcription, summaries and answers for you through our server and our providers, Groq and Anthropic, with OpenAI transcribing for subscribers when Groq is busy or unavailable.
Recording and on-device transcription work without an internet connection and without a subscription.
3. Own keys
- You need your own account with the provider (Anthropic, OpenAI, Google Gemini or an OpenAI-compatible service) and are bound by its terms and usage policies.
- The provider bills you directly for what you use. We do not control or refund those charges.
- Your key is stored only on your device. You are responsible for keeping it safe and for revoking it with the provider if you think it has leaked.
- We are not responsible for the provider's availability, results, charges or handling of your data.
4. Ellumo Cloud
- Ellumo Cloud includes a monthly allowance shown in the app (currently 600 minutes of transcription, with limits on summaries and questions). Unused minutes do not carry over to the next month.
- To keep the service sustainable, Ellumo Cloud may limit how many requests you make at once, and may pause for the rest of a day if total demand exceeds our daily capacity. Recordings wait in the app and continue later; nothing is lost.
- Content you send through Ellumo Cloud must also comply with the usage policies of our providers, Groq, OpenAI and Anthropic.
- We may change the providers or models behind Ellumo Cloud. If a change affects where your data goes, we will update the Privacy Policy and tell you in the app.
5. Subscriptions and automatic renewal
- Ellumo Cloud is sold as a monthly or yearly subscription through your App Store or Google Play account. Prices are shown in the app as the store provides them, in your currency, before you buy.
- The subscription renews automatically at the end of each period, at the then-current price, unless you cancel it at least 24 hours before the period ends. Your store account is charged within the 24 hours before the period ends.
- You can manage or cancel the subscription in your App Store or Google Play account settings (the app links there from Settings › Subscription). Deleting the app does not cancel the subscription.
- When you cancel, Ellumo Cloud stays available until the end of the paid period.
- Refunds are handled by Apple or Google under their policies. We cannot issue refunds for store purchases ourselves.
- If a price changes, the store tells you in advance and, where its rules require, asks for your consent.
6. Free trial
- Each installation of Ellumo gets a one-time free trial of Ellumo Cloud (currently 60 minutes of transcription and a small number of summaries and questions, as shown in the app).
- The trial needs no payment details and does not turn into a paid subscription on its own.
- The trial is granted once per installation, including after Delete all data. Attempts to get more trials by manipulating the app or our server are not allowed.
7. Minute packs
- A minute pack is a one-time purchase that adds extra Ellumo Cloud minutes (currently 300) to the identifier on your device that bought it. Pack minutes are used after the monthly allowance, only while you have an active subscription, and expire 12 months after purchase.
- Packs are consumable and cannot be restored. After Delete all data, or a restore that moves your purchases to a new identifier, unused pack minutes stay with the old identifier and are lost.
- If the store refunds a pack, its unused minutes are removed.
8. AI output may be wrong
Transcripts, summaries and answers are produced automatically by AI models. They can mishear words, names and numbers, leave things out, or state things that were not said. Check anything important against the recording. AI output is not legal, medical, financial or other professional advice.
9. Your recordings and your responsibilities
- Your recordings and everything made from them remain yours. When you use Ellumo Cloud you allow us and our providers to process them only as needed to provide the service.
- You are responsible for recording lawfully. Tell people that you are recording them and get their consent where the law requires it. Ellumo does not record phone calls.
- Do not use Ellumo to break the law or to violate other people's rights, and do not try to disrupt, overload, reverse engineer or get around the limits of Ellumo Cloud.
10. Changes and availability
We keep improving Ellumo and may add, change or remove features. We aim to keep Ellumo Cloud available but do not guarantee that it will be uninterrupted or error-free. If we ever stop Ellumo Cloud, we will tell you in advance, and recording, on-device transcription and Own keys will keep working.
11. Disclaimers and limitation of liability
Ellumo is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties not stated in these terms, and our total liability to you for any claim related to Ellumo is limited to the amount you paid us for Ellumo Cloud in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer under the law of the country where you live, or liability that cannot be limited by law.
12. Ending the agreement
You can stop using Ellumo at any time; cancel your subscription in the store and delete the app. We may suspend or end your access to Ellumo Cloud if you seriously or repeatedly break these terms; where possible we will tell you first. Sections 8, 9, 11 and 13 survive the end of this agreement.
13. Governing law
These terms are governed by the laws of {{COUNTRY}}. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.
14. If you got Ellumo from the App Store
- These terms are between you and us, not Apple. We, not Apple, are responsible for Ellumo and its content, for support and maintenance, and for handling any claims about it (including product liability, legal compliance and intellectual property claims).
- If Ellumo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation.
- You confirm that you are not in a country subject to a U.S. Government embargo and are not on a U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. Changes to these terms
We may update these terms. We will change the effective date above and, for significant changes, tell you in the app before they apply. If you keep using Ellumo after that, the new terms apply.
